By accessing or using Axgen's website and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access our Services.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms.

You are responsible for:

• Safeguarding the password you use to access our Services
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use our Services to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Transmit any harmful, threatening, or offensive content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the integrity of our Services

5. Intellectual Property

The Services and their original content, features, and functionality are and will remain the exclusive property of Axgen and its licensors. Our Services are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any content you submit, post, or display on or through our Services. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content in connection with providing our Services.

5a. Third-Party Services

Axgen integrates with third-party advertising platforms including Meta (Facebook and Instagram) and Google Ads. Your use of these integrations is also subject to those platforms' terms of service and privacy policies. You are responsible for complying with the policies of any platform you connect to Axgen.

We act on your behalf only within the scope of permissions you explicitly grant during the OAuth consent flow, and you may revoke those permissions at any time from Settings → Ad Accounts → Disconnect or from the connected platform's own settings (for example, Facebook Settings → Apps and Websites).

6. AI-Generated Content

Our Services utilize artificial intelligence to generate marketing content. You acknowledge and agree that:

• AI-generated content may require human review and editing
• We do not guarantee the accuracy or appropriateness of AI-generated content
• You are responsible for reviewing and approving all content before publication
• We are not liable for any consequences arising from the use of AI-generated content

7. Payment Terms

If you purchase any paid Services, you agree to pay all applicable fees. Payment terms will be specified at the time of purchase and may include:

• Subscription fees billed on a recurring basis
• One-time payments for specific services
• Usage-based fees calculated on consumption

All fees are non-refundable unless otherwise stated or required by applicable law.

8. Limitation of Liability

To the maximum extent permitted by law, Axgen shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or data
• Business interruption
• Loss of goodwill or reputation
• Any other intangible losses

Our total liability for any claims arising out of or relating to these Terms or our Services shall not exceed the amount you paid us in the twelve (12) months prior to the claim.

9. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that our Services will be uninterrupted, timely, secure, or error-free. We make no warranties regarding the results that may be obtained from the use of our Services.

10. Termination

We may terminate or suspend your account and access to our Services immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination, your right to use our Services will immediately cease. If you wish to terminate your account, you may simply discontinue using our Services or contact us to request account deletion.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms or our Services shall be resolved through binding arbitration in accordance with applicable arbitration rules.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of our Services after any changes to these Terms constitutes acceptance of those changes.
